Privacy Policy

How Dastivo collects, uses, discloses and protects personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

The responsible party for the personal information described in this policy.

Dastivo Financial Advisory (Pty) Ltd ("Dastivo", "we", "us", "our") is a registered financial advisory firm incorporated in South Africa, registration number 2018/452709/07, with its registered office at 56 Kloof Street, Gardens, Cape Town, 8001, South Africa. We are the "responsible party" as defined under POPIA for personal information processed through our website at dastivo.pro and in the course of providing our advisory services.

Information we collect

The categories of personal information we process and how we obtain it.

We collect personal information directly from you and, where relevant, through your use of our website:

  • Contact details — name, email address, phone number and company name submitted via our contact form or enquiry channels.

  • Engagement information — financial, tax and business details you share when engaging us for advisory, tax planning or wealth planning services.

  • Technical data — IP address, browser type, device information and pages visited, collected via cookies and similar technologies.

  • Analytics data — aggregated usage statistics collected where you have consented to analytics cookies.

Why we process your information

Our lawful bases and purposes for processing under POPIA.

We process personal information for the following purposes, each supported by a lawful basis under POPIA (consent, contractual necessity, legal obligation or legitimate interest):

  • To respond to enquiries submitted through our contact form and to provide requested information about our services.

  • To deliver tax planning, business advisory and wealth planning services under a signed engagement letter.

  • To comply with legal, regulatory, tax and anti-money-laundering obligations applicable to financial advisory firms.

  • To operate, secure and improve our website, and to understand usage through analytics where consented to.

  • To send relevant service updates or marketing communications where you have opted in, with an option to unsubscribe at any time.

Cookies and similar technologies

How our website uses cookies, and the choices available to you.

Our website uses cookies grouped into three categories, consistent with the cookie preference options presented to you on first visit: Essential cookies, required for core site functions such as secure browsing and form submission, which cannot be disabled; Analytics cookies, which help us understand how pages are used so we can improve our content and services; and Marketing cookies, used to show relevant offers about our consulting services on other sites. Sharing and hosting of information

Who we share personal information with and where it is stored.

We do not sell personal information. We may share personal information with trusted third parties strictly where necessary: hosting and infrastructure providers who store and process website data on our behalf; email and analytics service providers used to operate our contact forms and understand site usage; professional advisers (auditors, legal counsel, regulators) where required by law; and SARS or other regulatory bodies where disclosure is legally mandated. Our website is hosted using infrastructure that may process data outside South Africa. Where personal information is transferred across borders, we take reasonable steps to ensure recipients apply a level of protection substantially similar to POPIA, including contractual safeguards with our service providers.

Retention

How long we keep personal information.

We retain personal information only for as long as necessary to fulfil the purposes described in this policy, including satisfying legal, accounting, tax or reporting requirements. Client engagement records are typically retained for a minimum of five years after the conclusion of an engagement, in line with financial advisory and tax record-keeping obligations in South Africa. Contact form enquiries that do not proceed to an engagement are retained for a shorter period, after which they are securely deleted or anonymised.

Security

The measures we take to protect your information.

We implement appropriate technical and organisational measures — including encryption in transit, access controls and staff confidentiality obligations — to protect personal information against loss, unauthorised access, alteration or disclosure, as required under POPIA's Condition 7 (Security Safeguards).

Your rights

Your rights as a data subject under POPIA.

Subject to applicable law, you have the right to: be notified that your personal information is being collected; access the personal information we hold about you; request correction or deletion of inaccurate, irrelevant, excessive or unlawfully obtained personal information; object to processing of your personal information for direct marketing purposes; withdraw consent where processing is based on consent, without affecting processing carried out prior to withdrawal; and lodge a complaint with the Information Regulator of South Africa if you believe your rights under POPIA have been infringed.

Changes to this policy

How we notify you of updates.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The date of the last update will be reflected at the bottom of this page. Material changes will be communicated via our website or, where appropriate, directly to you.
